DISPUTE RESOLUTION DEPARTMENT

We specialize in debt recovery, security enforcement, regulatory compliance, election petitions, constitutional petitions, judicial review, competition law, real estate and construction disputes and general civil matters before tribunals such as the Political Parties Tribunal, Environment Appeal Tribunal, Cooperative Tribunal, Public Procurement Admin Review Board, other tribunals as well as the Magistrate’s Courts, the High Court and related Courts and the Court of Appeal.

GENERAL COMMERCIAL PRACTICE

Our competent team of Certified Company Secretaries deals with incorporation of various business entities, listing and post listing support, annual compliance, corporate governance advisory, domesticating foreign companies, conversion of entities eg partnerships to companies, conversion of entities eg partnerships to companies, administration and management of dividends, maintaining company’s register of members and other matters affecting shareholding, preparation of documents and submissions to the Registrar e.g. appointment, removal and resignation of a director, change of shareholders, local and foreign investment regulation, progressive application of Companies Act, 2015 and corporate restructuring.

Managing Partner

He is the Managing Partner and heads the Corporate, Commercial & Transactional Practices Department. He holds a Bachelor of Laws (Hons) from Moi University, Kenya School of Law, Diploma in Law and a program of negotiations from Harvard University Law School. He is an experienced business lawyer with a specifc bias in the areas of corporate & commercial law, property law & conveyancing, banking law and securitization and regulatory compliance.
He possesses a sound understanding of the business environment and more so in specialized industries, thus translating their broad range of legal needs into viable tailor made solutions.

Caroline Njari-Anyona

Associate

She is a sharp visionary thinker with a knack for staying ahead of the pack. She is a strong and driven advocate who lives for challenging matters and dives into work with excitement. Her main areas of Practice include commercial litigation, constitutional & administrative law, election law, employment law, criminal law, family law, judicial review, Commercial Arbitration, Regulatory Advisory and Compliance and general litigation practice. During her years of practice, she has handled matters ranging from commercial dispute, judicial review applications, environmental and land disputes, probate and electoral disputes.

Mr. Smartt is a resident of the United States, Africa, and Europe.  He currently works as managing director of African Global Development, SARL, an investment and infrastructure development firm.  He has practiced law since 1998 with a focus on corporate finance, real estate development, and banking.  Mr. Smartt is licensed to practice law in multiple jurisdictions within the United States, including the Federal Courts.  Mr. Smartt worked as a prosecutor and then transitioned into the private sector, establishing his firm in 2001.

Njeri Kagucia Omesa

Consultant

She is an Advocate of the High Court of Kenya working in Tanzania, East Africa, first with the East African Law Society (EALS) and then with the Community for Children’s Rights (CCR). She is a child protection professional and human rights advocate with 10 years experience in policy advocacy. Further she is a skilled facilitator with the ability to use various models for design and implementation of face to face and digital processes with a variety of stakeholders.

She has extensive experience in conducting community based research with a human development focus on telling stories that matter. She has been involved in building a community of practice on community based child protection and in building a coalition on care reform in Tanzania.

She is passionate about protection of the rights of every individual and ensuring access to quality life and empowering civic action. She is a member of the Transform Alliance Africa and a fellow of the prestigious International Human Rights Training Program with Equitas.
